Crash responsibilities

Find out what to do if you’re involved in a car crash in Victoria. In an emergency, dial 000.


If you’re involved in a car crash (an accident), make sure you: 

  • Stop immediately. 
  • Help any injured person. 
  • Provide your details to others involved in a crash (or their representatives) and to the police if they are there.
  • When you provide your details, include your name, address, vehicle registration number and vehicle owner’s name.
  • If anyone is injured and the police are not at the crash, you must report the crash to the nearest police station. 
  • If there is any property damage and the owner (or police) is not there, you must report the crash to the nearest police station.

You may be a driver in a car crash where someone died or was injured. Victoria Police may ask you to supply a blood sample to check for the presence of alcohol and drugs

Rules about crash responsibilities

The rules regarding crash responsibilities are published in Part 6 of the Road Safety Act 1986.

  • Section 61 - Duty of driver etc. of motor vehicle if accident occurs
  • Section 61A - Duty of driver etc. of vehicle that is not a motor vehicle if accident occurs.

You may be fined if you ignore the law

If you’re a driver involved in a crash where someone is killed or injured and you do not stop and give assistance, you can: 

  • be fined more than $200,000 
  • be imprisoned for up to 10 years 
  • lose your licence for at least two years.
